With reference to the above, I, K. Suresh, Assistant Commissioner (Group 'A'), currently under suspension vide the impugned order, most respectfully submit this representation on the following grounds:
1. The suspension order has been passed under Rule 10(1) of the Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957, without any preliminary assessment of the alleged charges. Rule 10(1)(a) clearly stipulates that suspension may be ordered only when a disciplinary proceeding is contemplated. However, no charge memo or statement of imputation has been served to date, rendering the suspension arbitrary.
2. The suspension violates Rule 20 of the Karnataka Government Servants (Conduct) Rules, 1966, which mandates that no government servant shall be penalized without due process. The order neither cites any rule nor provides reasons, thereby infringing the principles of natural justice.
3. The suspension has been prolonged beyond 90 days without review, in contravention of Rule 10(6) of the KCS (CCA) Rules, 1957, and the government's own circular No. DPAR 42 SAS 2022 dated 03.02.2022.
In light of the above, it is prayed that the suspension order may kindly be revoked and I may be reinstated with all consequential benefits.
